Terms of Use | Baran Performance

About these terms

This website is operated by Tomasz Baran, trading as Baran Performance under the trading name Baran Performance. You can contact us at Tomasz@baranperformance.com.

These terms explain the permitted use of this informational website. They do not create a Bench account or a subscription agreement. Nothing in these terms removes rights that you have under applicable law.

Bench is in development

Bench is being developed to support football training readiness and player development. This website shares information about the project, its direction and development progress.

Features, demonstrations and proposed services may change during development. Unless expressly confirmed, descriptions of planned features are not guarantees of availability or a commitment to a particular release date.

Any public app, account system or paid service will have separate terms explaining the service offered and the conditions that apply.

Training and health information

Training information, demonstrations and descriptions of readiness scores are provided for general information. They are not medical advice, a diagnosis, a treatment plan or confirmation that someone is fit to exercise.

A score based on self-reported information cannot establish that a player is injury-free or safe to train. It must not override symptoms, physical limitations, medical advice or an individual assessment by an appropriately qualified professional.

Physical activity involves risks. Choose activity, intensity, equipment and supervision appropriate to your circumstances. Seek qualified advice where needed rather than relying solely on website content or an automated recommendation.

We do not guarantee that Bench or the information on this website will prevent injury or produce particular athletic results. These statements do not remove any responsibility we have under applicable law.

Using the website

You may browse the website and share links to its public pages for lawful purposes.

Do not attempt to gain unauthorised access to systems, accounts or information.
Do not introduce malicious software or deliberately disrupt the website.
Do not use the website to commit fraud, impersonate others or infringe their rights.
Do not bypass security controls or misuse services connected to the website.

Content and intellectual property

Original website content and materials are owned by Baran Performance's operator or used with permission from the relevant rights holder. Third-party names, logos and materials remain the property of their respective owners.

You may view content for personal, lawful use. Reproducing, distributing or commercially exploiting protected material requires the relevant permission, except where permitted by law.

Linking to our website does not give permission to imply a partnership, endorsement or affiliation that does not exist.

Availability and external links

We aim to provide accurate information and a reliable website. Content may nevertheless contain errors or become outdated, and access may occasionally be interrupted for maintenance, technical faults or other reasons.

We may update website content and features as the project develops. This does not affect any separate contractual commitments or statutory rights.

Links to external websites are provided for convenience or further information. Those websites are operated independently and have their own terms and privacy policies. A link does not by itself indicate endorsement or a commercial relationship.

Privacy and contacting us

Our Privacy Policy explains how we handle personal information. Our Cookie Policy explains browser storage and your choices.

The contact button opens an email service so you can compose a message. It does not send an enquiry automatically. Please avoid sending passwords, payment-card details or sensitive medical information.

Payments and subscriptions

Bench Pro is planned and is not currently available to purchase through this website. Browsing the website or sending an enquiry does not start a subscription or authorise a payment.

Before a paid service becomes available, we will explain its price, included features, billing arrangements, cancellation process and applicable refund and consumer rights.

Responsibility and your legal rights

Our responsibility for loss or damage is determined by applicable law. We do not guarantee uninterrupted access, error-free content or particular training outcomes, but these statements do not exclude liability where the law makes us responsible.

Nothing in these terms excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or restricted.

Your statutory consumer rights and data protection rights remain unaffected.

Questions, applicable law and updates

If you have a question or concern, email Tomasz@baranperformance.com so we can review it. This does not prevent you from exercising your rights or contacting a relevant regulator.

These terms are governed by the laws of England and Wales, subject to any mandatory protections that apply where you live. They do not restrict any right you have under applicable law to bring proceedings in your local courts.

We may update these terms as the website develops. The effective date identifies the current edition. Updates to these website terms do not retrospectively change a separate agreement you have already entered into.
